All content within the website www.ccdnsw.org (hereafter referred to as the ‘Site’) is subject to the following terms and conditions.

By accessing, browsing, or registering as a network user with this Site you accept these terms and conditions.

Copyright

All content on this site is subject to copyright and other intellectual and cultural property rights owned by, or licensed to, Community Cultural Development NSW Ltd. (hereafter referred to as CCDNSW), or other external publishers of content to the Site.

Content on this Site includes content in the form of software, pdf format documents, text, graphics, flash artwork, still images, audio and video.

In using the Site’s content you:

(a) may (appropriate/reproduce/use) the content only for cultural or educational purposes. If you do, you must retain copyright and other intellectual and cultural property notices from the original material;

(b) must not use or distribute content from this Site for any public or commercial purpose; and

(c) must not breach copyright or any other intellectual or cultural property rights of CCDNSW, or its licensors, including by amending or adapting any content on this site.

Nothing you do on or in relation to this Site will transfer any copyright or other intellectual or cultural property rights to you, nor licence you to exercise any copyright, intellectual or cultural property rights, unless express permission is given by CCDNSW.

Editorial Policy

CCDNSW does not generally monitor or exercise editorial control over content posted by external Users. Views expressed on Network and Journal pages of this site are not necessarily the views of CCDNSW. In using this site you agree to regard any views expressed on those pages as the views of the author and not of CCDNSW.

However CCDNSW reserves the right to:

(a) access, examine, and edit any content posted by a registered network User; and

(b) at our discretion move, edit, or remove content posted by an external User, which CCDNSW considers to breach any law, to be offensive, discriminatory, culturally insensitive, contrary to the aims and purpose of CCDNSW and its website, or otherwise unacceptable or inappropriate;

(c) disable access to the site by, and/or to remove completely the contributions of any external User that is deemed by CCDNSW to have transgressed this Editorial Policy.

In using this Site you:

acknowledge that CCDNSW may remove or archive content posted by you in accordance with any applicable guidelines, such as those relating to period of storage, or to ensure the availability of server space.

agree that CCDNSW has no responsibility or liability for the deletion or failure to store any communications or other content maintained on, or transmitted on, this Site.

acknowledge that CCDNSW reserves the right to cancel accounts that are inactive for an extended period of time.

acknowledge that CCDNSW reserves the right to change procedures under this Policy at any time, at CCDNSW’s sole discretion, with or without notice.

In relation to all material you may post on the site, you:

(a) represent and warrant that the material is not confidential to or owned by any other person; and

(b) represent and warrant that the receipt of the material by CCDNSW is not illegal or defamatory and will not expose CCDNSW to any civil or criminal liability including, but not limited to, a warranty that the material is not misleading or deceptive or likely to mislead or deceive; and

(c) represent and warrant that you are authorised to make any listing on behalf of any organisation for which you make a network profile.

(d) represent and warrant that you are the copyright holder or appropriate licence holder of any image that you post to the site, and that you indemnify CCDNSW from any actions arising from a breach of the rights of any third party resulting from your posting.

(e) indemnify CCDNSW for any breach of the warranties contained in paragraphs (a) to (d) (inclusive).

Use of the online Calender

Users are free to post items to the CCDNSW online calender. Users are not however permitted to remove or edit another users' entry on the online calender. Only the web administrator or the original author of that posted item is permited to edit or remove that particular post.

Third Party Pages (external links)

CCDNSW is not responsible for any content found on a Third Party Page, or any site of which it forms a part. You must determine whether any page is part of this Site each time you follow a link to that page.

These Terms & Conditions may be revised at any time. You accept all such revisions when accessing any part of the Site, after that revision is made available on this Site.

This Site and any right or obligation under these conditions is governed by the laws of the state of New South Wales, and the parties submit to the jurisdiction of the courts of the state of New South Wales in respect of any action that arises under the agreement.
